The Brokerage Contract to Purchase: Why It’s A Good IdeaIf you had the choice to visit your family doctor or go to a walk-in clinic, which one would you choose? When it comes to your health, chances are you'd prefer to go see your own GP, who knows your file and understands your medical history. It's a lot more reassuring than simply going to a walk-in clinic every time you have a health concern. Chances are, you’ll never be seen by the same doctor, you’ll have no existing relationship with them, and they’ll have no prior knowledge of your medical history.

Well, guess what? The same concept applies when it comes to real estate brokers.

If you're looking to purchase a home, especially in today's crazy market, it's a lot better to establish a solid relationship with your own chosen real estate broker. Not only does it allow you to build trust with each other, but you can also act with the confidence of knowing that they have your best interests at heart. Doesn’t that sound better than simply dealing directly with the listing broker? They will likely be a stranger who you’ve only just met, with whom you have no prior relationship, and who has been hired by the seller to negotiate on their behalf.

This document is created by The Organisme d'Autoréglementation du Courtage Immobilier du Québec (OACIQ) - the regulatory government body that oversees consumer protection for residential real estate in Quebec. The Brokerage Contract to Purchase is an agreement between a real estate broker and a buyer designed to offer both parties maximum protection, while clearly establishing the terms and conditions under which the broker will act. It specifies, among other things:

The essential features of the desired property;

The essential features of the desired property;

The desired price and terms of purchase;

The buyer and the broker's respective obligations, including the remuneration of the buyer's broker (which can be paid directly by the buyer or added to the purchase price offered for the property and included in the mortgage loan).

By committing to a written agreement, both parties undertake to act in good faith and to ensure that the clients’ needs are being met at all times.
